Market readiness connects product classification and review with applicable establishment and advertising notices and a tariff-code-specific import check.

Classify the product before mapping its obligations

This guide is for brands, importers and local partners preparing to sell general cosmetics in Mexico. Review each product and real business activity: intended use and claims, formula and label, local operating roles, advertising plans and import classification all shape the work.

Articles 269–271 of the General Health Law define cosmetics and key classification boundaries. Article 270 also addresses safety and efficacy studies and cosmetic advertising notices. COFEPRIS lists applicable instruments and official entry points on its cosmetics page. [MX-LGS][MX-COFEPRIS-LEGAL-INSTRUMENTS]

Five review steps make the launch path verifiable

StepReview focus
ClassificationWhether use, contact area, application, formula and all claims remain within the cosmetics category.
Local operationsWhether the local establishment and actual activities trigger an Aviso de Funcionamiento and who keeps the records.
Product reviewWhether ingredient restrictions, applicable safety and quality studies, labels and claim evidence match the product version.
AdvertisingIf advertising, confirm the brand-based notice and current media information.
Import and maintenanceHave the importer or customs broker check applicable measures against TIGIE/NICO and maintain lot, complaint and change records.

Keep distinct notices and approvals separate

An establishment Aviso de Funcionamiento, a cosmetic advertising Aviso de Publicidad and any sanitary import permit or notice triggered by the goods and tariff code concern different matters. Do not assume a universal product registration or notification for every general cosmetic SKU; check the other applicable obligations. A practical project sequence

  1. Build a SKU list with use, contact area, target users, full formula and all claims.
  2. Screen classification risks, then assess ingredients, applicable studies and evidence gaps.
  3. Review the Spanish label, sunscreen requirements and claim substantiation before final artwork.
  4. Confirm local establishment and advertising responsibilities and the relevant notices.
  5. Verify TIGIE/NICO, import measures and clearance documents for the actual goods.
  6. Establish quality records, change review, complaint handling and recall procedures.

Product facts determine the applicable route

Repellent use, therapeutic or body-shaping claims, special ingredients or use cases may change classification or add requirements. Import controls also cannot be determined from the word “cosmetic” alone; check the precise code, use, import route and current official annex.

  • The classification decision and supporting facts are recorded.
  • The label, formula and study records match the same product version.
  • Establishment notices, advertising notices and import measures are assessed separately.
  • Official versions and provision locators are retained.
