Start with the quantitative formula and product category. Assess each existing study against the Mexican requirement before relying on it.

Build the evidence chain from the complete formula

Cosmetics documentation in Mexico should not rest on a supplier statement or a single “compliant” label. Work from the product, complete formula, use conditions and applicable rules, and connect ingredient identity, restrictions, relevant safety and quality studies, and product/formula versions.

Article 270 requires manufacturers, importers and sellers to hold safety and efficacy studies required by law and other applicable rules and provide them when requested. Article 271 Bis restricts animal testing for cosmetics while providing statutory exceptions. A historical animal-test report is not automatically acceptable; assess the applicable exception before relying on it. [MX-LGS]

Start with formula and identity

Mexico’s 2010 prohibited/restricted-substances agreement was amended in 2014 to update definitions and listed entries. Check each substance identity, use, concentration limit and condition; do not decide solely from similar INCI names or another market’s list. [MX-COSMETICS-INGREDIENT-AGREEMENT][MX-COSMETICS-INGREDIENT-AMENDMENT-2014]

  1. Obtain the complete quantitative formula, INCI or applicable names, functions, synonyms and explanations of blends.
  2. Check the current Mexican prohibited/restricted-substance agreement and amendments; record provisions, conditions and product use.
  3. Check whether the product category triggers irritation, sensitization, eye-irritation or microbiological controls.
  4. Make studies traceable to the sample, formula version, method, conclusion and label claims.

Articles 190–192 of the health-products regulation identify study or microbiological controls for specified product categories; NOM-089 provides a microbiological-content test method. Applicability depends on the product category and the exact provisions, so one test should not be generalized to all cosmetics. [MX-RCSPS][MX-NOM-089][MX-COFEPRIS-LEGAL-INSTRUMENTS]

Assess foreign studies individually

Existing reports generated under Chinese, ISO, EU or other systems can be assessed, but should not be promised as automatic substitutes for Mexican studies. Compare each report’s test, method and version, sample representativeness, product category and results with the applicable requirement; document any gaps.

PLATIICA lists NOM-259 as current. Its 2022 amendment changed transition periods, not the sections on production, quality control, complaints/returns/recalls, deviations and documentation. The standard applies to establishments processing and/or importing cosmetics marketed in Mexico and is distinct from an internally assembled technical dossier. • Formula and study records identify their versions.
  • Each restriction or study obligation has a current official locator.
  • Foreign reports are assessed individually for method, scope and sample fit.
  • Animal-testing restrictions and exceptions have been reviewed against the law.
