Regulatory Framework
South Korea regulates cosmetics under the Cosmetics Act through MFDS. The market distinguishes between general cosmetics and functional cosmetics such as whitening, wrinkle-improving, sunscreen, dyeing, perming, or anti-hair-loss products. For import projects, the compliance path combines local responsible entity readiness, formula and label review, customs reporting, and route-specific functional-cosmetics requirements.
Cosmetic Definition
Products applied to the human body by spreading, rubbing, spraying, or similar methods for cleansing, beautifying, increasing attractiveness, changing appearance, or helping maintain skin or hair in good condition, provided their effect on the human body is mild and they are not medicinal products.
Responsible Person Requirements
A foreign brand needs a South Korea-established company registered as a Responsible Cosmetic Distributor or equivalent local marketing entity. That company must manage formula and artwork review, import documentation, local release controls, and the qualified quality or safety management function required under the Korea framework.
Compliance Process
- Local Entity and Factory Quality Readiness
- Confirm the Korea-based responsible entity and align its internal quality and safety management role.
- Collect foreign factory GMP or production-control evidence for the local file.
- Formula and Artwork Screening
- Review the formula against Korea ingredient restrictions and category-specific requirements.
- Prepare compliant Korean labelling, ingredient naming, and local distributor information.
- Functional Cosmetics Review if Applicable
- For general cosmetics, confirm the product can stay outside the functional-cosmetics review path.
- For functional cosmetics, prepare the safety and efficacy package for the applicable MFDS route.
- KPTA Customs Reporting and Release
- Prepare the ingredient list, analytical documents, and manufacturing information used in the KPTA import reporting flow.
- Coordinate customs clearance, initial release checks, and local warehousing before sale.
Korea imports are tightly tied to local reporting and local-language ingredient presentation, so artwork and customs reporting should be prepared together rather than separately.
