Regulatory Framework
Cosmetics in Canada are overseen by Health Canada under the Cosmetic Regulations. Manufacturers and importers generally need to file a Cosmetic Notification Form after the product first enters the Canadian market, while formula safety, claims, and bilingual label expectations must be addressed before commercial launch.
Cosmetic Definition
A cosmetic is an item used to cleanse, improve or alter the complexion, skin, hair, nails, teeth, or body odours, including products such as skincare, makeup, shampoo, perfume, and toothpaste.
Boundary Alert: Products marketed with therapeutic, drug-like, or natural health claims may fall outside the standard cosmetics route and require a different assessment path.
Responsible Person Requirements
The manufacturer or importer is generally responsible for filing the cosmetic notification with Health Canada. For cross-border projects, the practical responsibility should be clearly split between the brand owner, the Canadian importer, and the local regulatory contact handling post-market communication.
Compliance Process
- Formula and Artwork Review
- Check ingredients against Canadian prohibitions, restrictions, and safety expectations.
- Review product naming, bilingual label presentation, claims, and required importer or company information.
- CNF Preparation
- Prepare the formulation details, artwork, and the notification form required for Health Canada.
- Confirm product identity, category, and responsible contact information before filing.
- Market Entry and Tracking
- Submit the CNF within the required post-market timeline after first sale in Canada.
- Record the resulting cosmetic number for tracking and future updates.
- Ongoing Compliance
- Maintain supporting safety data and respond to future update needs when formula or label changes occur.
- Prepare an internal flow for consumer incident follow-up and Health Canada communication.
The CNF record is a notification output and should not be treated as a Health Canada approval or market endorsement.
